GENERAL TERMS AND CONDITIONS
The name The Surf Tribe GmbH shall hereinafter be referred to as “The Surf Tribe.”
1. Contract agreement
Upon receipt of your written, telephonic or personal inscription, a contractual obligation is established between you and The Surf Tribe, provided that you have booked a trip pertaining to our operating service. We recommend you to book as early as possible since our offers are subject to a restricted number of participants.
2. Payment conditions
After your final booking, you will receive a confirmation by email. All travel arrangements, except for our extras, must be paid prior to departure.
For some destinations, it is possible to block your reservation by paying a non-refundable deposit. The amount of the deposit will be specified in your personal quotation.
The total invoicing amount must be transferred to our The Surf Tribe bank account.
If due payments are not made or not made in full and the traveler does not pay after a reminder with a final due date, The Surf Tribe is able to withdraw from the particular agreement and the booking will be considered as canceled

Tours and extras booked are to be paid on location on the day of arrival.
3. Cancellations and changes of reservation
If you cancel or change a The Surf Tribe reservation, you will be charged the non-refundable deposit (if foreseen) and the following cancellation fees:
- over 60 days prior to date of arrival: 30% of total amount or non-refundable deposit.
- 60 – 46 days prior to date of arrival: 50% of total amount.
- 45 – 31 days prior to date of arrival: 60% of total amount.
- 30 – 15 days prior to date of arrival: 80% of total amount.
- 14 – 3 days prior to date of arrival: 90% of total amount.
- Later or in case of no show up: 100% of total amount.
3.1 Changes in reservations
Changes of reservation from the booking date to 60 days prior to departure are free of charge. Changes of reservation up to 15 days prior to departure will be charged with a minimum fee of EUR 30 per change of reservation. In the event that, substantially, the change of reservation is to be deemed as a cancellation in part or full of the original arrangement, the above-referred cancellation terms apply to the canceled fraction.
3.2 Premature travel cancellation
If the customer interrupts his trip or changes services during the trip, there is no right to a refund from The Surf Tribe. If the customer interrupts his trip or changes services during the trip, the possible additional costs will be charged to the customer.
4. Cancellation by The Surf Tribe
In a case of force majeure, political unrest, travel restrictions, or other unexpected circumstances, The Surf Tribe reserves the right to cancel the trip. In this case, clients are entitled to a refund of the full amount paid in the form of a voucher that can be used for a future surf trip for the same destination, valid for a duration of 12 months from the date of cancellation.
4.1 Cancellation in case of non-fulfillment of participants' number
Some of The Surf Tribe surf retreats need a minimum number of participants in order to be confirmed. Therefore, The Surf Tribe reserves the right to cancel the trip also in case of non-fulfillment of the minimum number of participants. In this case, clients are entitled to a refund of the full amount paid. The cancellation in case of non-fulfillment of the minimum number of participants will be communicated within 30 days prior to the check-in date. All the information regarding the minimum number of participants and the cancellation policy in case of non-fulfillment will be specified on the website and on the quotation for the surf trips of interest .
Further claims for compensation are excluded.
5. Mandatory insurance
Sickness, accident, return trip, and cancellation insurance are mandatory for all participants. Therefore, our customers need to be privately insured in the event of an accident too. Surf lessons participants will sign a disclaimer of liability with the local surf school which provides the service. We also advise you to purchase baggage insurance.
6. Price changes
The Surf Tribe reserves the right to adjust its prices under certain circumstances (e.g. newly introduced or increased fees, government-enacted price rises, exchange rate changes in which the difference exceeds 10%).
7. Changes of program
In the interest of The Surf Tribe and our clients, we reserve the right to change the itinerary or specific services agreed upon if unforeseen events render it necessary. If a vital article of the contract is modified, The Surf Tribe will inform you as soon as possible and provide adequate compensation.
8. Immigration and health regulations
Participants assume the responsibility for all necessary travel preparation (passport, visa, vaccination). Regulations may vary depending on nationality. For further details please refer to the competent consulate or embassy.
9. Compensation and liability
An experienced tour operator, The Surf Tribe guarantees the following as far as the scope of your trip is concerned:
– Careful selection and scrutiny of other entities involved in your travel (providers of lodging, surf lessons, extra activities etc.)
– Truthful description in the online/offline communication
– Professional organization of your trip
The Surf Tribe compensates you for any loss generated by the failure, in part or in full, to provide a service agreed upon or for additional costs incurred by you, where The Surf Tribe guides or other local representatives were not able to offer you an equivalent alternative on the spot and where actual fault on your part can be excluded.
However, The Surf Tribe is not liable, if the non-performance or the improper performance of the contract is due to:
– neglect on the part of the customer
– unforeseeable or unavoidable failures of a third party not involved in the provision of the contractually agreed services
– force majeure or an event which The Surf Tribe or a service provider could not foresee or avert despite all due care.
The Surf Tribe is therefore not liable for changes in the itinerary due to strikes, riots, weather conditions, official measures, delays by third parties etc.
Complaints and claims must be asserted within 30 days after the conclusion of your journey booked with The Surf Tribe.
10. Prices
All the prices, except the prices for extra activities and services, are intended per person and per week.
11. Single use of the double room
For the single use of a double room, the surcharge applied depends on the destination and on the chosen package, and it varies between EUR 100 and EUR 300 per week per person. In case you want to change from the single-use to a normal double room use with another participant joining with you, we will refund the single-use surcharge. The second person accommodating in the room will have to pay for his/her own The Surf Tribe package according to the services she/he decides to book.
12. Pick-up service
If provided, the pickup service from the airport/bus station can only be booked until 24h prior to arrival.
13. Late check-in
For late check-ins, you will be charged an additional fee, depending on the destination. Normal check-in times will be communicated at booking confirmation.
14. Risk
It lies in the responsibility of the participant to select a trip that is in full conformity with his/her state of health and physical abilities. The Surf Tribe would like to draw your attention to the elevated level of risk entailed in adventure trips, namely surfing and fun sport tours (accidents may lead to injuries, disabilities or even death). Since The Surf Tribe does not exert any control over your mastery of these sports, The Surf Tribe does not assume any liability. Participants bear the full responsibility for accidents, loss inflicted on themselves or third parties or fatal accidents.
15. VAT
VAT is included in all of the prices listed.
16. Place of jurisdiction and applicable law
The contractual relationship between you and The Surf Tribe GmbH is governed exclusively by Swiss law. Legal action against The Surf Tribe GmbH can only be taken at its place of business in Einsiedeln/Switzerland.
17. Data protection
17.1 Your Data
The Surf Tribe requires various data (such as first and last name, date of birth, address, telephone number etc.) from the customers and fellow travellers for the correct processing of the contract. The Surf Tribe is subject to the Swiss Data Protection Act. The Surf Tribe is obliged to keep the customer data safe and stores it in Switzerland.
17.2 Transmission to service providers and authorities
The Surf Tribe only forwards your data as far as they are necessary for the contract processing with the service providers. These may be located abroad, where data protection may not correspond to Swiss standards. Both The Surf Tribe as well as the service providers may be obliged to forward customer data to (foreign) authorities due to legal regulations or official orders. This applies in particular, but not exclusively, to air [APIS]travel to the USA (Advance Passenger Information System , resp. TSA Secure Flight Program).
17.3 Enforcement of rights
The Surf Tribe reserves the right to forward customer data to authorities and third parties in order to enforce the legitimate interests of The Surf Tribe. The same applies in case of suspicion of a criminal offence.
